Personal data means data provided by you and/or obtained by Domino's Pizza Malaysia from its Related Companies (as defined hereunder) and/or any third parties which is capable of identifying you, directly and/or indirectly, which includes but is not limited to the following:-

  1. Your personal particulars such as your name, NRIC number and all details contained in your NRIC, address, contact details (such as telephone number(s), email address(es), home address(es), fax number(s)), race, gender, nationality and/or photographs/ images;
  2. CCTV images/ recordings captured at Domino's Pizza Malaysia's outlets;
  3. purchasing or transaction records;
  4. your membership with us and online account information, including your username, personalised ID number and password; and
  5. personal data collected automatically, which include internet protocol address (IP address), internet cookies, type of language used, access time and such other personal data relevant when you access Domino's Pizza Malaysia's website and/or mobile and/tablet applications.

PERSONAL DATA PROTECTION POLICY

This Personal Data Protection Policy is issued to all our valued customers pursuant to the requirements of the Malaysia Personal Data Protection Act 2010 (“the Act”).

Personal Data

Personal data means data provided by you and/or obtained by Domino's Pizza Malaysia from its Related Companies (as defined hereunder) and/or any third parties which is capable of identifying you, directly and/or indirectly, which includes but is not limited to the following:-

  1. your personal particulars such as your name, NRIC number and all details contained in your NRIC, address, contact details (such as telephone number(s), email address(es), home address(es), fax number(s)), race, gender, nationality and/or photographs/ images;
  2. CCTV images/ recordings captured at Domino's Pizza Malaysia's outlets;
  3. purchasing or transaction records;
  4. your membership with us and online account information, including your username, personalised ID number and password; and
  5. personal data collected automatically, which include internet protocol address (IP address), internet cookies, type of language used, access time and such other personal data relevant when you access Domino's Pizza Malaysia's website and/or mobile and/tablet applications.

 

The Websites or the Applications cannot collect any personal data about you unless you consent to it. You can visit and browse the Domino's Pizza Malaysia website mobile and the mobile and/or tablet applications without revealing personal data about yourself, but not all functions would be available to you. We may collect personal data from you when you:-

  1. communicate with us through the different platforms of ordering such as, but not limited to, through:
    1. our website;
    2. our mobile applications;
    3. our communication and social media accounts;
    4. our communication through electronic mail and messaging services;
    5. our call centre; or
    6. over the counter;
  2. place an order with us in person, via telephone or online ordering;
  3. provide instructions to a customer service representative about the delivery of your order;
  4. request that your order is delivered and the delivery is made by a driver who is using the GPS Driver App;
  5. interact with our social media account and pages or participate in any promotions or competitions through our social media platform and accounts;
  6. directly provide personal data to us pursuant to a request made by Domino’s Pizza Malaysia;
  7. register or subscribe to any products/services eg: newsletter, electronic messages or any other form of electronic direct marketing mailing list;
  8. participate in any of our surveys, focus groups or other marketing research activities done internally or via an appointed 3rd party;
  9. enter into /participate/win in any contest/competition/loyalty programs run by us;
  10. register interest and /or request for information or orders;
  11. respond to any marketing materials we send out;
  12. commence a business relationship with us;
  13. visit any of our stores;
  14. visit or browse our website;
  15. lodge a complaint with us;
  16. provide feedback to us;
  17. use our Wi-Fi networks or other in-store technologies;

Use of Personal Data

Domino's Pizza Malaysia uses the personal data collected for the following purposes, which shall include but are not limited to the following (hereinafter referred to as the “Purposes”):-

  1. to verify your identity;
  2. to assess and process your application(s)/request(s) for our products or services;
  3. for security purposes;
  4. to provide you with assistance, and the Products and /or Services you have requested (including services and functions on a downloaded Domino’s mobile application);
  5. to provide you with confirmation of your order (ie via email);
  6. to process any orders you place with us (including displaying your order name and order status on screen in store); to help you remember and reorder from our menu in the future;
  7. to administer and manage the Products and/or Services we provide you (including but not limited to ordering, delivery, complaints, follow up, feedback);
  8. to investigate and resolve any ordering, delivery, quality, complaints or other inquiries that you submit to us regarding our products and services;
  9. to detect and prevent fraudulent activities;
  10. to keep in contact with you and provide you with any information you have requested;
  11. to engage in business transactions in respect of Products and/or Services to be offered and provided to you;
  12. to process and job application you may submit;
  13. to establish and better manage any business relationship we may have with you;
  14. to process any communications you send us (eg: answering any queries and dealing with any complaints or feedback);
  15. unsubscribing your details from our database;
  16. to judge competitions, fulfilling prizes, awards and purchases;
  17. to determine the number of visitors to our website and conducting reviews of our website; to help us monitor and improve our Product and Service performances;
  18. to monitor and evaluate sales trends, stock management and sales and stock reporting;
  19. for advertising and direct marketing, including sending you updates, offers or information on products or services via any means such as, but not limited to, email, text message (SMS), phone or mobile device, instant messaging applications such as WhatsApp or similar applications, social media applications, postal mailings to the extent permitted by applicable laws, that we consider will be of interest to you, and authorizing selected third parties to send their offers or information on products or services where you have indicated interest in or consented to receiving third party offers. If you had earlier indicated your consent to receiving marketing or promotional updates from Domino's Pizza Malaysia and no longer wish to do so, you can always opt-out of receiving such updates and messages by selecting the unsubscribe link provided in our email, unsubscribing to any WhatsApp message you receive from us or by contacting our customer service through feedback form or any other method as may applicable from time to time;
  20. to maintain and develop our business systems and infrastructure, including testing and upgrading of these systems as we are always working on continuous improvement;
  21. to manage staff training and quality assurance;
  22. to notify you about benefits and changes to the features of our Products and/or Services;
  23. to determine how we can improve services to you, including analysis of orders and purchasing habits;
  24. to produce data, reports and statistics which shall be anonymized or aggregated in a manner that does not identify you as an individual;
  25. to investigate, respond to, or defend claims against Domino's Pizza Malaysia, including its parent company and/or subsidiaries and/or commonly owned and/or controlled companies (collectively, the “Related Companies”);
  26. to conduct marketing activities (including market research, focus groups, panels and surveys) so that we can better understand the needs of our customers and tailor our future Products and/or Services accordingly;
  27. to send you materials, newsletter and latest information on promotions, offers and new products/services via any means such as email, text message (SMS), phone or mobile device, instant messaging applications such as WhatsApp, our social media accounts, postal mailings to the extent permitted by applicable laws, where you have consented to receive such communications;
  28. to maintain and/or update records required for internal investigations, audit or security purposes;
  29. to comply with any obligations under the applicable laws; and
  30. for any other relevant purposes directly and/or indirectly related to the above purposes.

    By using or continuing to use our Product and/ or Services and providing your personal data, you consent to the use of your personal data for the above purposes. The use of your personal data for these purposes is necessary in our legitimate interests.

Disclosure of Personal Data

Personal data collected in relation to the foregoing Purposes may be and/or may have been disclosed to, but are not limited to, the following third parties stated herein:-

  1. to meet the purpose for which it was submitted;
  2. any company related to Domino's Pizza Malaysia and its Related Companies;
  3. relevant local and government authorities, law enforcement agencies and such other bodies in compliance with the law and/or order of any Court;
  4. entities which we are required or permitted by applicable law to disclose your personal data to;
  5. companies and/or organisations that act as our agents, contractors, service providers and/or professional advisers, including if your personal data is collected in connection with a joint promoter or service provider, to that joint promoter or service provider for marketing and research purposes;
  6. companies and/or organisations that assist us in processing the personal data;
  7. where you use a credit card to place an order via our website or mobile applications, to our credit card processor who will receive and process your credit card details for such orders;
  8. where you place an order online and express an interest in certain third party offers, products and services, we may provide and share your personal data with the providers of those third party offers, products and services including external creative agencies, advertising and marketing companies and third party suppliers of goods and services so they can contact you directly to advertise and market their goods and services to you and to personalise the advertising and promotional material you receive from us and them;
  9. agents, affiliates or service providers who act on or on behalf of us in connection with our business, or for further processing in accordance with the purpose(s) for which the personal data was originally collected;
  10. our business associates and other parties for purposes that are related to the purpose of collecting your personal data;
  11. third party sub-contractors and/or service providers appointed by Domino's Pizza Malaysia and/or the Related Companies to perform the business activities and activities directly and indirectly related to the business of Domino's Pizza Malaysia and/or the Related Companies; and
  12. other parties in respect of whom you have given your consent, or who were notified to you at the time of collecting your personal data.

"Cookies" and Advertisers

Domino's Pizza Malaysia use cookies to identify you. A cookie may be used in the processing of your personal data. A cookie is a text file placed into the memory of your computer and/or device by Domino's Pizza's Malaysia's server. A copy of this text file is sent by your computer and/or device whenever it communicates with Domino's Pizza's Malaysia's server. Domino's Pizza Malaysia may also collect the following data from you (which is not exhaustive) during your visit to Domino's Pizza Malaysia's Website and/or Application:-

  1. the date and time you accessed each page of Domino's Pizza Malaysia's Website and/or Application;
  2. the URL of any webpage from which you accessed Domino's Pizza Malaysia's Website and/or Application; and
  3. the web browser that you are using and the pages you accessed.

Some web pages may require you to provide a limited amount of personal data in order to enjoy certain services on Domino's Pizza Malaysia's Websites such as system login credentials, email address and contact. These personal data will only be used by Domino's Pizza Malaysia for the aforesaid Purposes only.

Domino's Pizza Malaysia's Websites and Applications may contain links to other web sites not maintained or related to Domino's Pizza Malaysia. These links are provided as a service to users and are not sponsored by or affiliated with the Domino's Pizza Malaysia or its websites or its mobile and/or tablet applications. These websites may have their own privacy statement in place and we recommend that you review those statements if you visit any linked web sites. Domino's Pizza Malaysia shall not be responsible for the contents on the linked sites and/or any use of your personal data by these sites and/or any collection of personal data from you, whether by consent or otherwise.

Tracking applications

If you are employed or engaged as a delivery driver at one of our stores, we may require you to install a mobile application, GPS Driver App, to your mobile device and use the application during your shift. The GPS Driver App will assist us and our customers to monitor the progress of order deliveries and aims to ensure the safety of our delivery staff.  The Information collected by us via the App may include:

  1. your location at all times during your shift; and/or
  2. data from your mobile device to detect unsafe driving behaviour such as speeding or harsh braking and acceleration.

Payment details

We do not store any credit card details for in-store orders.

Online orders can be paid by cash in store, credit card, debit cards, e-vouchers or gift certificates. Your credit card details are required to process payment on the internet order system however the full details are not saved once the order is processed. The credit card details we hold are: the name on the card, expiry date and the masked version of the credit card (ie first 6 digits and last 4 digits).

If you are a registered member of the online ordering system, you may have the ability to save your preferred payment method. You will be able to update this at any time by logging in to your registered account. We reiterate that your full payment details are not stored in your Domino’s registered account, but rather with our PCI compliant payment gateway providers including Maybank, Grab and Kiple. Please see “Disclosure of Personal Data” section about for more information.

Clickstream data and advertising

Each time you visit our websites our server collects some anonymous information, known as click-stream data, including the type of browser and system you are using; the address of the site you have come from and move to after your visit; the date and time of your visit; and your server's IP address.

Domino's may collect this information for statistical purposes to find out how the websites are used and navigated, including the number of hits, the frequency and duration of visits, most popular session times. Domino's may use this information to evaluate and improve the Domino's websites.

To try and bring you offers that we think may interest you, we have relationships with third party that we allow to place advertisements on our websites. If you visit our websites, ad serving or data analytics companies may place cookies on your browser to capture information from you such as your domain type, your IP address, your web usage behaviour whilst on the page (including how you were referred to the page), Google-authenticated identifiers and clickstream information. Any information collected by such third parties is subject to the third party’s privacy policies and terms of use.

Applications for smart devices

Domino’s Pizza Malaysia offers various applications for smart devices; these applications allow you to (amongst other things) order pizzas, track your order, locate your nearest store and receive vouchers or current deal notifications.

You will be able to access your Domino’s online ordering account using these applications.

In addition to recording your smart device’s IP address as part of your online order, your smart device’s ID may also be recorded in order to effectively provide you with the application’s services.

A Domino’s application may seek to activate location tracking services on your smart device. This function may result in your location being used for purposes such as:

  1. marketing (i.e. a nearby store sending you a special deal); or
  2. identification of your closest Domino’s store.

You will have the ability to opt out of these location tracking services by:

  1. declining this option when first prompted by the application; or
  2. manually turning this function off within your smart device’s settings.


Links to other sites

Our website may contain links to other websites of third parties. A link to a third party website is not an endorsement of the accuracy or trustworthiness of that website or its content and any information collected by such websites will be subject to that website's privacy policy.

The Domino’s Pizza Malaysia website may be accessible through or contain connections to areas where you may be able to publicly post information, communicate with others, review products and submit media content. Prior to posting in these areas please read the Domino’s Terms and Conditions and this Personal Data Protection Policy carefully. All the information you post may be accessible to anyone with internet access and any Information you include in your posting may be read, collected and used by others.

External accounts

You may be provided with the option to create a Domino’s Online Ordering account using an existing third party account, such as Facebook or Google (“External Account Provider”) account (“External Account”), You acknowledge and agree that:

  1. your Domino’s Online Ordering Account will only be accessible whilst your External Account remains active;
  2. Domino’s Pizza Malaysia will obtain from the External Account Provider any personal information required to create your new Domino’s Online Ordering account;
  3. Domino’s Pizza Malaysia may require you to input additional information, to that provided by the External Account Provider, in order to create your Domino’s Online Ordering account;
  4. You must sign-in to your Domino’s Online Ordering account using the relevant External Account Provider button on the ‘Login’ section of our website;
  5. You will be unable to use the email address associated with your External Account to create an account on the Domino’s website (independent of your External Account) whilst your External Account remains linked to your Domino’s Online Ordering Account;
  6. Your use of the External Account is governed by the External Account Provider’s own terms and conditions and Domino’s Pizza Malaysia will not be responsible for anything to do with your use of the External Account.

Security

Domino's Pizza Malaysia will endeavour to take such practical and reasonable steps to safeguard your personal data against any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction by having regard:-

  1. to the nature of the personal data and the harm that would arise;
  2. to the place or location where the personal data is stored;
  3. to any security measures incorporated into any equipment in which the personal data is stored;
  4. to the measures taken for ensuring the reliability, integrity and competence of personnel having access to the personal data; and
  5. to the measures taken for ensuring the secure transfer of the personal data.

Domino's Pizza Malaysia will endeavour to ensure that any security policy developed or implemented by Domino's Pizza Malaysia complies with the security standard required under the Act and any applicable law that may from time to time be in force.

Retention

Any personal data supplied by you will be retained by Domino's Pizza Malaysia for such period as is necessary for the Purposes set out herein and/or as may be deemed necessary by Domino's Pizza Malaysia and/or where otherwise required by law.

Subject to any exception under applicable laws and pursuant to the Act, you may at any time hereafter request access to, correction or deletion of your personal data supplied to Domino's Pizza Malaysia.

Domino's Pizza Malaysia reserves the right to change or amend this Personal Data Protection Policy at any time. This Personal Data Protection Policy may also be modified or amended by Domino's Pizza Malaysia at any time.
